A general construction contractor was unable to complete a contracted project causing its insurance bonding company to hire and pay another construction company to complete the contract. The insurance bonding company suspected the owner of the construction company of “busting out” the company violating the terms and conditions of its bond and hired the team at Stanley I. Foodman, P.A. to investigate its suspicions. What happened? We confirmed the insurance bonding company’s suspicions with our expert testimony leading to a successful litigation and recovery of its additional construction costs as well providing local law enforcement with the ammunition needed for an insurance fraud prosecution.

Case Studies

A corporate business with its real estate in foreclosure goes into a bankruptcy proceeding expecting to lose the real estate and related business in which the shareholder has invested fifteen years of his time and all of his family fortune. By the end of the proceeding the property sells for a large seven figure amount that pays off the foreclosed mortgages on the real estate, the business creditors and the costs of the bankruptcy proceeding leaving the shareholder with a seven figure residual amount.

What happened? A Forensic Accounting analysis of the mortgage notes revealing usury and expert witness testimony about the usurious notes brought all of the parties together for an out-of-court settlement approved by the bankruptcy court allowing for a sale of the real estate at the prevailing market price.
